Terms and Conditions

This document sets out the Terms and Conditions (“the Terms”) you need to be aware of when using our website and business. Please read these terms carefully. By using, purchasing from or engaging Organise For Calm, you signify that you agree to these terms and conditions. 
We reserve the right to modify this Agreement and/or the Policies (and update Organise for Calm Web Page on which they are displayed) from time to time. A date stamp will be applied at the top of the page therefore it is important that you check this page regularly.

1. Definitions
“Consultation” means the appointment between yourself and Organise for Calm
“Services”
 refers to Decluttering, Organising, Purging,  Moving House and Airbnb set up (and other short term rentals) Services. This includes one-on-one sessions, program(s), content, e-learning material, and online sessions. 

2. General Disclaimer 

2.1 Organise for Calm is not responsible for items that have been thrown away, donated or destroyed. Once your professional organiser and you have agreed on an items fate and it has been actioned, there will be no guarantee that the item can be recovered.

2.2 You as the client are responsible for actions that are taken with items. 

2.3 We can take a small amount of rubbish and take donations for you (what will reasonably fit in the boot of a car) at a small charge. 

2.4 Donations- we can provide a drop off service for a recycler or op shop – only for items that are clean and in good working order. This will be added to your invoice as travel costs associated with the facility drop off.

2.5 We do not sell any of your items on your behalf. We can take photos of your items and research sale prices for you, which will be charged at the hourly rate.

2.6 Rubbish – we can dispose of a small amount of rubbish or e-waste at a local council transfer station/tip facility. This will be added to your invoice as travel and costs associated with the facility drop off. Alternatively, you can dispose of your own rubbish in your council bin, or for larger volumes of rubbish you can arrange a local skip bin provider.

2.7 Organise for Calm will not be liable for change of mind, return of rubbish, return of  items for donation, once the service has been completed and items have been removed from site.

2.8 We do not lift or move heavy furniture. If you are wanting these services provided, please let us know at least a week in advance so we can get a quote from a local removalist company to provide this separately.

2.9 Assembly of basic furniture/flat packs may be able to be provided on discussion at an additional cost. Please provide at least a week’s notice so we can discuss if this should be outsourced to a separate handy-person service. 

2.10 We do not drill or mount any items, such as permanent picture hooks or fixed cabinetry. As above, provide at least a week’s notice so we can discuss if this could be outsourced to a separate tradesperson.

2.11 We will be capturing before, during and after photos of the session to track our progress and for record keeping of services delivered. We may share de-identified photos of our work on our website or social media channels, to inspire others on their organising journey. Delivering a private and respectful service within your home is extremely important to us. If you do not wish to have any de-identified photos of your space shared, that is absolutely fine, please ensure you let us know.

2.12 Organise for Calm is a Professional Organisation service, that while greatly complements cleaning services, is not a cleaning service itself. We will make sure all the surfaces we are working on are wiped down (eg shelving or cupboard spaces) and may do some light vacuuming when furniture is moved before its placed back.

2.13 As part of our initial onsite consultation, we can assess for potential additional storage items and take measurements if you are interested and time permits. On request, we can create an emailed list with links to discussed storage items for you to purchase yourself, ready for use in our session. Time spent on storage item research and email provision will be charged at an hourly rate. Direct purchase of storage items by Organise for Calm may occur if agreed to, with costs required upfront prior to purchasing.

3. Links

3.1 By using our website, you acknowledge that it will contain links to third party websites. The inclusion of these links do not imply that Organise for Calm endorses, or have investigated or verified the linked content of the websites.

3.2 We cannot therefore make any warranties or representations related to these links and cannot be held responsible for the functionality, safety, reliability and security of these websites. This includes the copyright compliance, legality, decency, privacy policy, privacy practices or any other aspect of such websites.

3.3 You acknowledge that you enter any third party websites at your own risk. It is your responsibility to review any terms of use or privacy policies relevant to such websites.

4. Bookings & Payment

4.1 Payment of services and/or products for Organise for Calm will be in Australian Dollars (AUD). We accept Cash, MasterCard and Visa and Direct Deposits. Credit Card numbers are protected through encryption when transmitted via the Internet.

4.2 All prices displayed of products and/or services on our website can be changed without notice.

4.3 Organise for Calm requires a deposit of 50% of the estimated cost of your onsite session in order to secure your booking. This is 50% of the time you’ve selected for our session, travel (if applicable) and other outlined costs. This 50% deposit is payable at the time of booking. This deposit is non- refundable and will be lost if your appointment is cancelled within 48 hours before your scheduled consultation time. You may also be issued an invoice for the remaining 50% fee, to be paid on 7 days.

4.4 Final payment is due within 7 days of invoice issue., If additional work hours are mutually. Agreed and delivered beyond the initial time period booked for, these will be added to your invoice. 

4.5 Late payments for services will incur additional charges. This will be at a rate of 10% per week, for the period the account is due until the date paid. If recovery action is required (through a collection agency/and or law firm) you will be liable for all incurred associated costs.

5. Consultations

5.1 Where the Client wishes to reschedule, they will be required to do so with a minimum of 48 hours notice. Failure to do so, or “no show” appointments will attract a 50% (deposit) cancellation fee.

5.2 Where the client wishes to cancel or amend a booking, they are to email hello@organiseforcalm.com.au or call 0493 350 673 as soon as practical. As per Clause 5.2, rescheduling of appointments will be available if 48 hours notice is provided

5.1 Organise for Calm cannot be liable for the delivery of our services outside our reasonable control including but not limited to: war, strikes, lockouts, government restrictions, personal illness, transport delays, natural disasters, power outages, theft, accidents of any kind or act of terrorism. Should such circumstances occur, we will endeavour to get in touch with the client to reschedule another appointment at a time suitable for both parties. 

5.3 Where we feel a Client’s case is outside the scope of our practice, we may refer your case to another organisation. 

5.4 Use of third party providers. In some cases it may be necessary to engage Third Party Service providers to complete a job. Organise for Calm would first seek your approval before engaging a Third Party Provider on your behalf. You may incur additional fees associated with this service.

Organise for Calm will not be held responsible for goods damaged in transit via third party logistics providers, or be responsible for the management and/or performance of third party providers.

5.5 Although unlikely, we reserve the right to cancel your booking at our discretion if necessary. Should this occur (unless it is a result of safety concerns during a session), we’ll provide as much notice as possible and issue a full refund of any fees paid.

5.6 Respect/Courtesy/Working with team members. We understand that at times services such as decluttering can become stressful and overwhelming for clients, and we’re experienced working in these conditions and will aim to create a safe and suported place to work together. 

Organise for Calm do not accept any harassment, intimidation or aggression from clients, and reserve the right to cancel bookings if there is concern with a client’s behaviour.


6. Confidentiality   

6.1 As our Client, you warrant to Organise for Calm that to the best of your knowledge, that the information provided to us is true and accurate.

6.2 All material considered strictly confidential by either party shall be designated as confidential. 

6.3 With the exception of being subpoenaed by a Court, or under circumstances where we have reasonable information to believe that the failure to disclose such information would place you or another person at serious and imminent risk (whereby your next of kin would be contacted), where your prior approval has been obtained, or where disclosure is otherwise required by the Law, your information will be kept confidential. 

7. Liability  

7.1 You agrees to hold Organise for Calm harmless from any and all claims, demands, liabilities, losses, damages, judgments or settlements, including all reasonable legal costs and expenses which may arise directly or indirectly as a result of any promise, representation, warranty, act, omission or obligation of Organise for Calm in respect of the:

(a)    provision of Services and/or content made available to the Client; and/or

(c)    any breach of these terms (or associated terms) by the Client.

8. Disclaimer: No Warranty or Guarantees

9.1 Content provided on our website is conveyed without any warranty or condition, express or implied. You agree that you consume this information at your own risk.

9.2 Nothing in this agreement shall constitute by Organise for Calm an express or implied warranty or guarantee as to the outcomes that may be obtained from use of the Services.

9. Exchange or Refunds for Goods
9.1 If a Product arrives in a damaged state, and it was a fault from us, a replacement or refund will be offered. Please ensure you advise us within 14 days of receipt. 

9.2 Incorrect orders received at the fault of Organise for Calm will be replaced at no charge to you. 10.3 Where there is a change of mind in product, or a product is ordered incorrectly by you,  credit will be provided to you, provided that you notify us of the error within 7 days of the date of date of receipt of goods and the products back to us. So long as they are unopened, not tampered with and are in a resalable condition.
9.4 Other requests for cancellations of order(s) or refunds will be at the sole discretion of Organise for Calm, and will be assessed on a case by case basis. Such refunds and/or exchanges will be exclusive of any postage and handling costs. 

10. Dispute Resolution

  If the Client has a complaint about the Service they have received from Organise for Calm, please contact us directly through hello@organiseforcalm.com.au. Mediation will be the first cause of action, if communications between the Client and Organise for Calm in an attempt to resolve the dispute has exhausted. 

11. Copyright

  The content, information, graphics and logos on our Website or any of its Platforms are owned and controlled for these purposes by Organise for Calm. You are not allowed to modify, rent, lease, loan, sell, distribute or create derivative works based on any of the Content (either in whole or in part) unless you have been provided with prior written permission from us.

12. Over the Age of 18

By engaging us, you acknowledge that you represent and warrant that you are over the age of eighteen (18) or have gained appropriate parental or guardian consent to engage Organise for Calm for our services, that all registration information you submit is truthful and accurate.

13. Governing law and jurisdiction 

  This agreement is governed by the laws of the State of Victoria, Australia. Each party will submit to the jurisdiction of the courts exercising jurisdiction of Victoria, Australia.

14. Law enforcement

  Organise for Calm reserves the right to cooperate fully with any law enforcement authority in any jurisdiction in respect of any lawful direction or request to disclose the identity or other information in respect of anyone posting or sending any materials and/or content, which violate any applicable or relevant law.
